Terms and Conditions

Welcome to EchoDate ("the App," "our App," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the EchoDate mobile application, website, and all related services (collectively, "the Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

1. Eligibility

To use EchoDate, you must meet the following requirements:

• Age Requirement: You must be at least 18 years of age to create an account and use EchoDate. By registering, you represent and warrant that you are at least 18 years old. We reserve the right to request verification of your age at any time and to terminate accounts that violate this requirement.
• Legal Capacity: You must have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
• No Prior Bans: You must not have been previously banned, suspended, or removed from the Service by us.
• Compliance with Laws: You must comply with all applicable local, national, and international laws and regulations when using the Service.
• Truthful Information: All information you provide during registration and throughout your use of the Service must be accurate, current, and complete.

2. Account Registration and Security

2.1 Account Creation

To access most features of EchoDate, you must create an account by providing:

• A valid email address
• A secure password
• Your name, date of birth, and gender
• At least one profile photo

You may also sign in using Apple Sign-In or other supported third-party authentication providers.

2.2 Account Security

• You are solely responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately if you suspect unauthorized access to your account.
• We are not liable for any losses resulting from unauthorized use of your account.
• You may not share your account with any other person or allow others to access the Service through your account.

2.3 Email Verification

We require email verification to activate your account. Unverified accounts may have limited functionality until verification is completed.

3. User Conduct and Prohibited Activities

You agree to use EchoDate in a manner that is lawful, respectful, and consistent with these Terms. You must not:

• Harassment and Abuse: Harass, bully, intimidate, stalk, or threaten any other user.
• Hate Speech: Post or communicate content that promotes hatred, discrimination, or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Impersonation: Impersonate any person or entity, including EchoDate staff, moderators, or other users. Use of names containing "verified," "admin," "moderator," "official," "support," "echodate," or "staff" is prohibited.
• Fraudulent Activity: Engage in scams, fraud, catfishing, or any deceptive practices.
• Sexual Content: Share explicit, pornographic, or sexually suggestive content, including nudity, in profiles, messages, or during calls.
• Spam and Commercial Use: Send unsolicited promotional content, advertisements, or spam. Use the Service for any commercial purpose without our written consent.
• Illegal Activities: Use the Service to facilitate any illegal activity, including but not limited to prostitution, human trafficking, drug dealing, or money laundering.
• Malicious Software: Upload, transmit, or distribute viruses, malware, or other harmful code.
• Data Mining: Use automated systems, bots, scrapers, or crawlers to extract data from the Service.
• Interference: Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Minor Safety: Solicit personal information from, or attempt to contact, anyone under the age of 18.
• False Reporting: Submit false, misleading, or malicious reports against other users.

4. User Content

4.1 Your Content

You retain ownership of all content you create, upload, or share through EchoDate ("User Content"), including profile photos, bio text, messages, and media shared in chats. By posting User Content, you grant EchoDate a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.

4.2 Content Standards

All User Content must comply with these Terms and our community guidelines. Content that violates our rules may be removed without notice. We reserve the right to review and moderate all User Content.

4.3 Responsibility

You are solely responsible for your User Content. We do not endorse, guarantee, or assume liability for any User Content posted by users. You understand that by using the Service, you may be exposed to content that is offensive, inaccurate, or otherwise objectionable.

5. Identity Verification

EchoDate offers an optional identity verification feature ("Verify Identity"). By using this feature:

• You consent to providing a live selfie/video that will be compared against your profile photo using face detection technology.
• Verified users receive a verification badge visible to other users.
• Verification does not guarantee the accuracy of a user's identity or intentions.
• We may revoke verification status if we determine the verification was fraudulent or if you change your profile photo to one that no longer matches your verification.
• Verification data is processed in accordance with our Privacy Policy.

6. Subscriptions and Purchases

6.1 Subscription Plans

EchoDate offers the following subscription tiers:

• Free: Basic access with limited daily connections and messaging.
• EchoDate Plus: Includes unlimited swipes, voice and video calls, advanced filters, the ability to see who liked you, and privacy controls.
• EchoDate Premium: Includes everything in Plus, plus profile boosts, priority in discovery, incognito mode, read receipt controls, and exclusive features.

6.2 Billing and Renewal

• Subscriptions are billed through the Apple App Store or Google Play Store ("App Stores").
• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• The renewal charge will be applied to your payment method within 24 hours of the end of the current period, at the same price you originally subscribed at unless we have notified you of a price change.
• You can manage and cancel your subscription through your Apple ID or Google Play account settings at any time.

6.3 Virtual Currency (Coins)

EchoDate uses a virtual currency system ("Coins") that can be purchased with real money:

• Coins are used to send virtual gifts, purchase cosmetic items (avatar frames, chat backgrounds, chat bubble styles), boost your profile, and access special features.
• Coins have no real-world monetary value and cannot be exchanged for cash or transferred to other users.
• Purchased Coins are non-refundable except as required by applicable law.
• We reserve the right to modify the pricing and availability of Coin packages at any time.
• Coins that have been used to purchase items or send gifts cannot be recovered.

6.4 Virtual Gifts

Virtual gifts are digital items that can be sent to other users as expressions of interest or appreciation. Gifts are purchased using Coins and have no monetary value. Once sent, gifts cannot be recalled or refunded.

6.5 Store Items (Cosmetic Purchases)

The EchoDate Store allows you to purchase cosmetic items using Coins, including:

• Avatar Frames: Animated borders displayed around your profile photo.
• Chat Backgrounds: Custom gradient themes for your chat screen.
• Chat Bubble Styles: Custom message bubble designs and colors.

All Store items are permanent once purchased and are non-refundable. Store items are cosmetic only and do not affect the functionality of the Service.

6.6 Refund Policy

• All purchases are processed through the Apple App Store or Google Play Store.
• Refund requests must be directed to the respective App Store.
• We do not process refunds directly. Apple and Google handle refund requests in accordance with their respective refund policies.
• Used Coins, sent Gifts, activated cosmetic items, and expired subscription periods cannot be refunded.

7. Voice and Video Calls

• Voice and video calls are available to users with an active Plus or Premium subscription.
• Calls require an active internet connection and may consume significant data.
• You agree not to record, screenshot, or capture any calls without the explicit consent of all participants.
• We do not record, monitor, or store the content of voice or video calls.
• Call functionality is provided through third-party infrastructure (LiveKit) and availability may vary based on network conditions.
• By using the call feature, you consent to the collection of call metadata (duration, type, timestamps) for service improvement and dispute resolution.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Intellectual Property

9.1 Our Property

The Service, including all software, designs, text, graphics, logos, icons, images, audio clips, animations, and their arrangement (collectively, "EchoDate Content"), is the exclusive property of EchoDate and is protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms. This license does not include:

• Modifying, copying, or distributing any EchoDate Content
• Reverse engineering, decompiling, or disassembling the software
• Using the Service for any commercial purpose
• Creating derivative works based on the Service
• Framing, mirroring, or otherwise incorporating the Service into another website or application

9.3 Feedback

Any feedback, suggestions, or ideas you provide to us regarding the Service may be used by us without restriction or compensation to you.

10. Third-Party Services

The Service integrates with or relies upon the following third-party services:

• Supabase: Backend infrastructure, database, and authentication
• LiveKit: Real-time voice and video call infrastructure
• Expo / React Native: Mobile application framework and push notifications
• RevenueCat: In-app purchase and subscription management
• Apple App Store / Google Play Store: App distribution and payment processing

These third-party services have their own terms and privacy policies that you should review. We are not responsible for the practices of these third-party services.

11. Blocking, Reporting, and Content Moderation

• Blocking: You may block any user at any time. Blocked users cannot see your profile, contact you, or interact with you. You can manage your blocked users list in Settings > Privacy > Blocked Users.
• Reporting: You may report users who violate these Terms. Reports are reviewed by our team. You may optionally block a user when submitting a report.
• Moderation: We reserve the right to review, moderate, and remove any content or accounts that violate these Terms, without prior notice.
• False Reports: Submitting false or malicious reports may result in the suspension or termination of your own account.

12. Termination

12.1 By You

You may terminate your account at any time by:

• Requesting account deletion through Settings > Privacy > Delete Account
• Contacting our support team at support@echodate.me

Account deletion is permanent. Upon deletion, all your data, matches, messages, purchased items, Coin balance, and subscription benefits will be permanently removed and cannot be recovered.

12.2 By Us

We reserve the right to suspend or terminate your account, at our sole discretion, without prior notice, for any reason, including but not limited to:

• Violation of these Terms or our community guidelines
• Engaging in prohibited activities as described in Section 3
• Providing false or misleading information during registration
• Creating multiple accounts
• Using the Service in a manner that could harm other users or the integrity of the Service
• Inactivity for an extended period (12+ months)

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Any unused Coins, active subscriptions, and purchased items will be forfeited. We are not obligated to provide refunds upon termination for cause.

13. Disclaimers

• We do not guarantee that the Service will be uninterrupted, secure, or error-free.
• We do not conduct criminal background checks on users and make no representations regarding the character, integrity, or trustworthiness of any user.
• We are not responsible for the conduct of any user, whether on or off the Service.
• We do not guarantee any specific results from using the Service, including but not limited to finding a match or romantic partner.
• Verification badges indicate that a user has completed our face verification process. They do not guarantee the identity, intentions, or character of a user.
• We are not responsible for the quality or reliability of voice and video calls, which depend on your device, internet connection, and third-party infrastructure.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• EchoDate, its officers, directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.
• We are not liable for any damages resulting from:
  • Your interactions with other users, whether online or in person
  • Unauthorized access to or alteration of your data
  • Content posted by other users
  • Service interruptions or technical failures
  • Actions taken based on User Content

15. Indemnification

You agree to indemnify, defend, and hold harmless EchoDate, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any rights of a third party
• Your violation of any applicable law

16. Dispute Resolution

16.1 Informal Resolution

Before filing any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@echodate.me. We will attempt to resolve the dispute within 30 days.

16.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EchoDate operates, without regard to its conflict of law provisions.

16.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration, except for claims that qualify for small claims court. You agree to waive your right to a jury trial and to participate in class action lawsuits.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Sending you a push notification or email
• Displaying a notice within the App

Your continued use of the Service after any changes constitutes acceptance of the modified Terms. If you do not agree with the revised Terms, you must stop using the Service and delete your account.

18. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and EchoDate regarding your use of the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• No Agency: No agency, partnership, joint venture, or employment relationship is created by these Terms.
• Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemic, labor disputes, or government actions.
